Terms of Service

Purpose

These Terms of Service (ToS) govern access to and use of the Trasimène mobile application and the website trasimene.app, published by TRASIMENE SAS (61 Rue de Lyon, 75012 Paris). The application provides mobile security services: antivirus, VPN, encrypted digital vault and dark web monitoring.

Access Conditions

Age: access to the service is restricted to persons aged 18 or over. Minors may use the service only with the express consent and under the responsibility of their legal guardian.

Account: each user may create only one account. Creating an account implies full acceptance of these ToS and the Privacy Policy.

Accuracy: users undertake to provide accurate information upon registration and to keep it up to date.

Acceptable Use

The following uses of the Trasimène service are strictly prohibited:

  1. attempting to circumvent, neutralise or reverse-engineer the application's security mechanisms;
  2. reselling, sublicensing or transferring access to a third party;
  3. using the application for unlawful, fraudulent or public-order-violating purposes;
  4. performing automated operations (scraping, reverse engineering, fuzzing) against the Trasimène API or servers;
  5. sharing login credentials with other individuals.

Service Availability

Trasimène endeavours to keep the service available 24/7. Occasional interruptions may occur for maintenance, updates or events beyond our control (force majeure). No contractual SLA applies to consumer subscriptions. TRASIMENE SAS will notify users of planned maintenance with reasonable notice.

Liability

Best-efforts obligation: Trasimène undertakes to implement all reasonable means to secure your device. No 100% protection against all cyber threats is technically possible.

Limitation: TRASIMENE SAS shall not be liable for indirect damages, data loss, financial loss or reputational harm resulting from the use or inability to use the service.

Third parties: Trasimène is not responsible for the content, products or services of third-party websites accessible via links in the application.

Termination

By the user: termination may be effected at any time from the personal space (section My subscription). It takes effect at the next billing date. No pro-rata refund is made unless there is a proven billing error.

By Trasimène: TRASIMENE SAS reserves the right to suspend or close an account in the event of a breach of these ToS, with prior notice except in cases of seriously abusive conduct.

Intellectual Property

All intellectual property rights relating to the Trasimène application (source code, design, trademarks, detection algorithms, knowledge base) are the exclusive property of TRASIMENE SAS. A subscription grants the user a personal, non-exclusive, non-transferable right of use. Any other use requires prior written authorisation.

Amendments to the ToS

TRASIMENE SAS may amend these ToS at any time. Users will be informed of material changes by email or in-app notification at least 15 days before they take effect. Continued use of the service after this period constitutes acceptance of the updated ToS.

— 09 —

Governing Law and Jurisdiction

These ToS are governed by French law. In the event of a dispute, the parties undertake to seek an amicable solution. Failing agreement, any dispute shall be submitted to the exclusive jurisdiction of the courts of the Paris Court of Appeal.
