General Terms of Sale

Purpose and Scope
These General Terms of Sale (GTS) apply to any subscription to the services of TRASIMENE SAS (61 Rue de Lyon, 75012 Paris — SIRET 103 240 560 00013 — VAT FR13103240560) via the website trasimene.com or the Trasimène mobile application. They take precedence over any other customer document unless otherwise agreed in writing.

Plans and Pricing
The Trasimene app and its security features are free. Only the built-in VPN requires a paid subscription, at the following prices (inclusive of applicable VAT):
TRIAL
No trial period is offered: the app and its security features are already free, with no credit card required. Only the VPN requires a subscription.
MONTHLY
VPN — Monthly: €3.99 / month — 1 device (Android or iOS), cancellable at any time.
ANNUAL
VPN — Annual: €39.99 / year — 1 device, equivalent to €3.33 / month (saving of 16.6% vs monthly).
1 subscription = 1 device. Use on multiple simultaneous devices requires multiple subscriptions.
Prices are subject to change. Any price change will be notified 30 days before it takes effect.

Payment Terms
Payment is made by credit card (Visa, Mastercard, American Express) via RevenueCat Inc., our payment and subscription management provider, backed by a PCI-DSS Level 1 certified payment provider. No card data is stored by TRASIMENE SAS. Billing occurs on the subscription date, then automatically at each renewal date. An invoice is generated and available in the personal space after each payment. VPN subscriptions purchased via the App Store (Apple) or Google Play are billed by the respective platform under its own terms; TRASIMENE SAS has no access to your payment data in that case.

Automatic Renewal
Subscriptions are automatically renewed for the same period as originally subscribed (monthly or annual), unless cancelled by the user before the renewal date. In accordance with art. L215-1 du Code de la consommation (French Consumer Code), for annual subscriptions, TRASIMENE SAS informs the user in writing of their right not to renew the contract, no earlier than three months and no later than one month before the renewal date. Cancellation is available at any time, free of charge and online, from the personal space (Settings → Manage my subscription). TRASIMENE SAS reserves the right to modify the renewal price with 30 days notice. For a subscription purchased via the App Store or Google Play, renewal and cancellation are managed directly in your account settings on the respective platform.

Right of Withdrawal
Under Article L221-18 of the French Consumer Code, consumers have 14 days from the date of subscription to exercise their right of withdrawal, without giving any reason.
ART. L221-28
Exception — express waiver: pursuant to Article L221-28 of the French Consumer Code, by clicking Start my subscription and requesting immediate performance of the service before the withdrawal period expires, you expressly acknowledge waiving your right of withdrawal. This waiver is confirmed in writing (order confirmation email).
As no trial period is offered, the 14-day withdrawal period runs from the date of subscription to the paid VPN plan. For subscriptions purchased via the App Store (Apple) or Google Play, the exercise of the right of withdrawal and refunds are governed by the terms of the respective platform.

Cancellation
The user may cancel their subscription at any time from the personal space (section My subscription → Cancel). Cancellation takes effect on the next billing date. Access to the service is maintained until that date.
TRASIMENE SAS may cancel the subscription immediately in the event of a material breach of the ToS, with a pro-rata refund for the unused period.

Refunds
No refund is made for the current subscription period in the event of voluntary cancellation, except for: (1) a billing error attributable to TRASIMENE SAS; (2) total inability to access the service for more than 72 consecutive hours due to Trasimène. Refund requests must be sent to contact@trasimene.com within 30 days of the event.

VAT and Invoicing
TRASIMENE SAS is registered for VAT purposes in France (number FR13103240560). The applicable VAT rate is the French standard rate (20%) or the rate applicable in the customer's EU member state of residence. Invoices are available in PDF format in the personal space.

Mediation and Disputes
In the event of a dispute, users are invited to contact customer support first: contact@trasimene.com. Failing an amicable resolution, in accordance with articles L612-1 et seq. du Code de la consommation (French Consumer Code), consumer customers may have free recourse to a consumer mediator. The contact details of the competent mediator are provided upon written request to contact@trasimene.com and published on this page. Disputes are subject to the courts within the purview of the Paris Court of Appeal, subject to the protective provisions applicable to consumers, who may bring proceedings before the courts of their place of residence.

Governing Law
These GTS are governed by French law. The Vienna Convention on Contracts for the International Sale of Goods does not apply. In the event of translation of these GTS, only the French version shall prevail.
